Rhode Island , HB 222 was signed into law by Governor Gina Raimondo on 6/01/18. This bill makes it clear that you are guilty until proven innocent. “At a hearing to terminate a one-year extreme risk protection order prior to its scheduled date of expiration, the respondent shall have the burden of proving by clear and convincing evidence that the respondent does not pose a significant danger of causing imminent personal injury to self or others by having a firearm in their custody or control, or by purchasing, possessing, or receiving, a firearm. The court may consider any relevant evidence, including evidence of the considerations enumerated in § 8-8.3-5. In addition, the court may consider whether the respondent complied with the court’s recommendation that the respondent undergo a mental health and/or substance abuse evaluation.”
These Red Flag laws violate a citizens I, II, IV, V, VI, VIII and XIV Amendment rights. It was modified with a Substitute 1 clause that allows for tougher penalties on someone who files a “false” claim, however, remember only law abiding citizens follow laws. This does not make the law more Constitutional as portrayed in the media as it still does not address the law of due process or innocence until proven guilty.
